10. Data Protection Compliance

As a requirement of the Data Protection Act, 2019 and the Data Protection (Registration of Data Controllers and Data Processors) Regulations, 2021, all public and private organizations and individuals processing personal data must register with the Office of the Data Protection Commissioner (ODPC). Mfano Bora Africa Limited is fully registered and complies with all ODPC guidelines for managing driver data.

11. Responsibility for Shared Data

You are responsible for ensuring the legality and accuracy of the personal data you share with us for processing, storage, and retrieval. The effective date of this Data Processing Agreement (DPA) is the date of the last party’s acknowledgment.

Mfano Bora Africa Limited will not disclose Customer Data to third parties without authorization from the Customer, unless required by law. If disclosure is legally required, we will provide prior notice to the Customer unless legally prohibited from doing so.

13. Definition of Customer Personal Data

Customer Personal Data refers to any personal data that Mfano Bora Africa Limited processes on behalf of the Customer. This includes personal data controlled by the Customer or processed by the Customer on behalf of other data controllers.

14. Definition of Personal Data

Personal Data means any information relating to an identified or identifiable individual. This includes, but is not limited to, name, ID number, staff number, and phone number.

15. Data Subject Requests

Mfano Bora Africa Limited will notify you without undue delay of any requests received from data subjects exercising their rights (e.g., correction, deletion, or access). We will not respond directly to such requests unless legally required or explicitly instructed by you in writing.

16. Confidentiality Obligations

All Mfano Bora Africa personnel authorized to process Customer Data are required to maintain confidentiality and only process such data as instructed by the Customer or required by law. Personnel receive annual security and privacy training, and confidentiality obligations remain in effect indefinitely.

17. Data Return or Deletion

Upon expiration or termination of our agreement, or upon written request, Mfano Bora Africa Limited will either return or delete Customer Data. Deleted data will be rendered permanently unreadable. We will confirm in writing once data has been deleted, if requested.

18. Written Form Acknowledgement

References to "written form" in this agreement include electronic forms such as email communication, unless otherwise specified by law.

19. Responsibility and Liability

Each party is responsible for their respective actions and compliance under this DPA. Each party bears its own costs and liabilities associated with fulfilling these obligations.
